FootingDepot, LLC (“FootingDepot” or “FD”) is committed to ensuring your privacy is protected. This Privacy Policy (“Policy”) describes how FootingDepot collects, uses, shares, and protects information from and about you, along with choices you can make about such information, when you use or visit our applications or websites (collectively, our “Website”) or otherwise interact with us. How We Share Your Information

We may share your information for our business purposes and as legally required or permitted by law. Please see below for examples of circumstances in which we share information:

    • With our affiliated companies in connection with our use of your information and to enable our affiliates to use your information for their own purposes.
    • With third parties who perform services on our behalf such as data analysis, website hosting, content syndication, social media integration, marketing, information technology and related infrastructure, our customer service chatbot, and payment processing/billing. These entities may have access to your information if needed to perform their functions. If such access is required, the third parties will be obligated to maintain the security of that information. They are restricted from using, selling, distributing or altering this data in any way other than to provide the requested services to FootingDepot.
    • With third parties in connection with cookies, pixels, and other tracking technologies implemented on our Website (see “Cookies” section below).
    • For research and analytical purposes such as to evaluate and improve our products and business operations.
    • In the event of a corporate change in control (for instance, a merger), FootingDepot may disclose your information to interested parties and their advisors in connection with the transaction and may transfer or assign your information to the new party in control or the party acquiring our assets. In such circumstances, we would seek to ensure the acquiring party follows the practices described in this Policy. We cannot promise, however, that an acquiring company or the merged company will have the same privacy practices or treat your information the same as described in this Policy.
    • To professional advisors, such as lawyers, bankers, auditors, and insurers, where necessary in the course of the professional services that they render to us.

For instance, we may share such information to assess, improve, and develop our products and services, and for other research and analytics purposes. We also may share aggregate information with our partners and other third parties about the collective demographics or Website users or how they collectively use our products and services.
    • With your consent or at your direction. In addition to the sharing described in this Policy, we may share your information with third parties whenever you consent to or direct such sharing.

How We Protect Information

We maintain reasonable administrative, technical, and physical safeguards designed and intended to protect your information against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure, or use. Despite these safeguards, due to inherent uncertainty in the use of the internet and information systems and the potential for unlawful attacks by third parties, we cannot guarantee that the use of our systems or Website will be completely safe or secure.

We retain information for as long as it is needed or useful to provide and improve our products and services, comply with our legal obligations, resolve disputes, operate our business, and enforce our agreements.

Some features of the Website may require the use of a password or access code. You are solely responsible for maintaining the security of your password or access code. You may not disclose your password or access code to any unauthorized third parties and are solely responsible for any use of or action taken under your password or access code. FootingDepot will not be liable for any loss or damage from your failure to maintain the security of your password or access code.

Managing Your Marketing Preferences

You will have the opportunity to receive future mailings or promotional offers or consent to the use of your information for other purposes by clicking one or more “opt-in” boxes provided on the Website. AI Assistant & Online Chat

FootingDepot provides an optional AI-powered chatbot to support general inquiries and information requests. Chatbot interactions, including any information you disclose through the chatbot, may be processed by a third-party AI service provider leveraging an OpenAI model for response generation purposes. While the chatbot is designed to assist visitors, users should not enter sensitive, confidential, or proprietary information.

State Privacy Rights

Some states, including but not limited to California, grant their residents certain data privacy rights, which may include the following:

  • Right to Access: You may have the right to request a copy of the specific pieces of PII that we have collected about you in the previous twelve (12) months. The information will be delivered by mail or electronically. Upon receipt of a Verifiable Consumer Request, we will disclose the information required by law.
  • Right to Data Portability: You may have the right to receive your PII in a portable, readily usable format that allows you to transmit your information to another entity without hindrance.
  • Right to Correct Inaccurate Information: You may have the right to request that we correct inaccurate information about you that we maintain.
  • Right to Deletion: You may have the right to request that we delete your PII.
  • Right to Be Free from Discrimination: You may have the right to not be discriminated against by us for exercising any of your rights under applicable law or regulation.

To exercise your rights, please send a Verifiable Consumer Request to the contact information in the ‘How to Contact Us’ section. The Verifiable Consumer Request must provide sufficient information to allow us to reasonably verify you are the person about whom we collected personal information or an authorized representative and must describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with PII if we cannot verify your identity or authority to make the request and confirm the PII relates to you. We will only use PII provided in a Verifiable Consumer Request to verify the requestor’s identity or authority to make the request.

Please be aware that your rights (including those enumerated elsewhere in this Policy) are limited to the extent permitted by applicable law. The exact scope of these rights may vary by state.

California Privacy Rights

In addition to other rights granted to California residents, California’s “Shine The Light” law (California Civil Code §1798.83), permits California residents to request certain information regarding our disclosure of Personal Information (if any) to third parties for direct marketing purposes. If you are a California resident and would like to make such a request, please submit your request in writing using the contact information in the ‘How to Contact Us’ section.

Residents of Nevada

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Nevada residents who wish to learn more about their opt-out rights and/or to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request by contacting us in accordance with this Policy.

Do Not Track

Do Not Track is a privacy preference that users can set in their web browsers. When a user turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the user. Our Website does not currently respond to “Do Not Track” or similar signals.

Children’s Privacy

FootingDepot recognizes the importance of children’s safety and privacy. Our Website is not intended for use by children under the age of 18. We do not request, or knowingly collect, any information from children under the age of 18.
